IOn Sleep Terms of Service

These terms are an agreement between you and The Ritz Plaza LLC, a South Dakota limited liability company doing business as The IOn Project ("we", "us"). They cover the IOn Sleep Android app (package com.theritzplaza.ionsleep) and Premium. How we handle your information is explained separately in the IOn Sleep privacy policy.

By installing or using IOn Sleep, or by continuing past a screen that says you agree to these terms, you accept them. If you do not agree, please do not use the app. If you use the app on behalf of someone else, such as a child in your care, you accept these terms for them too.

3. Who can use IOn Sleep

4. Your license to use the app

The app, its sounds, artwork, text and code belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to install and use IOn Sleep on devices you own or control, for your own non-commercial use, in line with these terms and Google Play's terms. The app is licensed to you, not sold. We keep every right we do not expressly give you here.

7. Free trial

The first time you sign in with Google, you get 7 days of Premium free, with no ads. The in-app trial costs nothing and does not turn into a paid subscription by itself. When it ends, the app goes back to the free version unless you subscribe. The trial is one per person. We may decline or end a trial that we reasonably believe is being reused or obtained through a breach of these terms. If you subscribe during the trial, your subscription runs on the schedule Google Play shows you, and any unused trial days are not added to it.

9. Ads in the free version

If you use IOn Sleep as a guest or on the free version, the app shows ads, including banner ads and occasional full-screen ads. Ads are served by Google AdMob. People with Premium or an active free trial do not see ads. Ads come from third-party advertisers, so we do not endorse the products advertised, and anything you buy from an advertiser is between you and that advertiser. How ad data is collected, and how to limit ad personalization, is explained in section 5 of the privacy policy.

10. Alarms: please keep a backup

We work hard to make alarms reliable, but no phone app can guarantee that an alarm will ring. Whether an alarm rings on time depends on things outside our control, including:

Do not use IOn Sleep as your only alarm for anything important, such as a flight, an exam, a work shift, taking medication or caring for someone. Use a second alarm for those. Test your alarm after you install the app, after updates, and after you change battery or permission settings. Wake-up challenges, such as solving a problem or taking steps, are optional. Only use a challenge you can complete safely when you have just woken up.

12. Your content and feedback

Notes and ratings you add to your sleep sessions are yours and stay on your phone. If you send us feedback or ideas, you let us use them to improve our apps, free of charge and without any obligation to you. We will not publish your name with your feedback without your permission.

13. Third-party services

IOn Sleep relies on services run by other companies, including Google Play, Google sign-in and Firebase, Google AdMob and OpenWeather (for weather themes). Those services have their own terms and privacy policies, and we are not responsible for them, for their availability, or for the accuracy of data they supply, such as weather. The privacy policy lists what each one receives.

14. Changes to the app

We update IOn Sleep from time to time. We may add, change or remove features, and we may stop offering the app. If we stop offering Premium while you have an active paid subscription, we will tell you in advance where we reasonably can, and you can ask for a refund for the unused part of your paid period.

15. Disclaimers

16. Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, for our gross negligence or willful misconduct, or for death or personal injury caused by our negligence. Some places do not allow certain disclaimers or limits, so some of sections 15 and 16 may not apply to you. Where that is the case, our liability is limited only as far as the law allows.

17. Indemnity

If someone brings a claim against us because you broke these terms or the law while using IOn Sleep, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows. This does not apply to claims caused by our own fault.

18. Ending these terms, and deleting your account

19. Changes to these terms

We may update these terms. We will change the date at the top when we do. If a change is material, for example to pricing, liability or how disputes are handled, we will tell you in the app or on the Google Play listing before it takes effect. Changes do not apply to past events. If you do not agree to a change, stop using the app and cancel any subscription before the change takes effect. Continuing to use the app after that means you accept the updated terms.

20. Governing law and disputes

These terms, together with the privacy policy, are the whole agreement between you and us about IOn Sleep. If a court finds part of them unenforceable, that part is limited as little as necessary and the rest stays in effect. If we do not enforce a term straight away, we can still enforce it later. You may not transfer these terms to anyone else. We may transfer them to a company that takes over IOn Sleep, and your rights under them will continue. We are not responsible for delays or failures caused by events outside our reasonable control.
