IOn Reclaim Terms of Service

These terms are an agreement between you and The Ritz Plaza LLC, a South Dakota limited liability company doing business as The IOn Project ("we", "us"). They cover the IOn Reclaim Android app (package com.ionproject.reclaim), which helps people quit or cut down on nicotine. They apply to every version of the app, including earlier versions that offered Pro and an AI coach (see section 10). How we handle your information is explained separately in the IOn Reclaim privacy policy.

1. The short version

• IOn Reclaim is a self-help tool, not medical advice. Talk to a doctor or pharmacist about quitting, especially about medication.
• Need urgent help? In the US, call or text 988. Otherwise, contact your local emergency services.
• IOn Reclaim 1.7.0 and later is free, with no subscription, no ads and nothing to buy.
• If you bought Pro in an earlier version, Google Play handles that purchase, including cancelling and refunds. Section 10 explains what to do.
• We cannot promise you will quit. The app gives you tools and estimates. The effort and the decisions are yours.
• This summary is for convenience. The numbered sections below are the actual terms.

2. Accepting these terms

By installing or using IOn Reclaim, or by continuing past a screen that says you agree to these terms, you accept them. If you do not agree, please do not use the app.

3. Who can use IOn Reclaim

• IOn Reclaim is intended for adults. You must be at least 18 years old, or the age of majority where you live if that is higher.
• You may not use the app if United States law prohibits you from receiving it, for example because you are in an embargoed country or on a US government restricted-party list.

4. Not medical advice

IOn Reclaim is a self-help tool, not medical advice. Talk to a doctor or pharmacist about quitting, especially about medication. In particular:

• IOn Reclaim is not a medical device, a treatment, or a clinical or professional cessation program. It does not diagnose or treat nicotine dependence, withdrawal or any other condition, and it is not a substitute for care from a qualified health professional.
• Talk to a doctor or pharmacist before you start, stop or change nicotine replacement therapy (such as patches, gum or lozenges) or any quit-smoking medication, and before following a taper plan, especially if you are pregnant or breastfeeding, have a heart, lung or mental health condition, or take other medicines.
• Health milestones, savings figures, craving predictions and similar content are general estimates. They are not measurements of your body or a prediction of your personal health, and they may not apply to you.
• We do not promise that you will quit, cut down, or avoid relapse. Results depend on you and many things outside our control.
• If you have symptoms that worry you, see a doctor.

5. If you need urgent help

If you are in crisis or thinking about harming yourself: in the US, call or text 988. Otherwise, contact your local emergency services. In a medical emergency, contact your local emergency number straight away. IOn Reclaim cannot respond to emergencies, and nobody monitors what you enter in the app.

6. Your license to use the app

The app, its content and its code belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to install and use IOn Reclaim on devices you own or control, for your own non-commercial use, in line with these terms and Google Play's terms. The app is licensed to you, not sold. We keep every right we do not expressly give you here.

7. Acceptable use

Please do not:

• copy, sell, rent, redistribute or publish the app or its content;
• decompile, reverse engineer or modify the app, except where the law allows this despite this restriction;
• interfere with, attack or overload our systems or the services the app relies on, or try to access anyone else's data;
• in earlier versions, misuse the AI coach, for example by trying to make it produce harmful content or by sending it automated requests; or
• use the app in a way that breaks the law or harms others.

8. Accounts, Google sign-in and cloud backup

• You can use IOn Reclaim as a guest. Signing in with Google is optional and lets you use cloud backup.
• If you sign in, keep your Google account secure. You are responsible for what happens in the app under your sign-in.
• Your quit data is stored on your phone. A copy goes to our cloud storage only when you are signed in and choose Cloud Backup. We do our best to keep backups working, but we do not guarantee that a backup or restore will succeed or be complete, so please also keep your own export of anything you would not want to lose.
• You can delete your account and data at any time. See section 17.

9. IOn Reclaim is free

IOn Reclaim 1.7.0 and later is free to download and use. It has no subscription, no free trial, no in-app purchases and no ads, and every feature is included. If we ever decide to charge for something in the future, we will tell you clearly in the app before you pay anything, and these terms will be updated first.

10. Pro and the AI coach in earlier versions

Versions of IOn Reclaim before 1.7.0 offered an optional Pro upgrade through Google Play, as a monthly or annual subscription or a one-time purchase, along with a 7-day free trial for signed-in users and an AI coach powered by Google's Gemini service. If you used either:

• Billing is through Google Play. Google Play took the payment and handles billing, cancellation and refunds under its own terms and refund policies. We never saw your card or payment details.
• Cancelling a subscription. A Pro subscription renews until it is cancelled. Updating to 1.7.0, uninstalling the app, or deleting your account does not cancel it. Cancel in the Google Play Store under Payments and subscriptions, then Subscriptions. You keep access for the time you have already paid for.
• Refunds. Every former Pro feature is now free, and the AI coach has been removed. If you paid for Pro and want a refund, email us. Google Play lets us issue refunds, and we will handle every request fairly. Nothing here limits any refund right you have under the law where you live.
• The AI coach. The coach's replies were generated automatically by AI. They could be wrong, incomplete or unsuitable for you, and they were never medical advice or a substitute for a health professional. Messages you sent were processed by Google under Google's terms, as the privacy policy explains. Version 1.7.0 removes the coach.
• If you still use an earlier version, these terms apply to it as well. Please update to the latest version.

11. Your content

What you enter in IOn Reclaim, such as your logs, notes, motivations and your "personal why", is yours. We use it only to provide the app's features to you, as the privacy policy describes. If you send us feedback or ideas, you let us use them to improve our apps, free of charge and without any obligation to you.

12. Third-party services

IOn Reclaim relies on services run by other companies, including Google Play, Google sign-in and Firebase, and, in earlier versions, Google's Gemini service and Google Play billing. Those services have their own terms and privacy policies, and we are not responsible for them or for their availability. The privacy policy lists what each one receives.

13. Changes to the app

We update IOn Reclaim from time to time. We may add, change or remove features, and we may stop offering the app or cloud backup. If we plan to stop offering cloud backup, we will tell you in the app in advance where we reasonably can, so you can export your data.

14. Disclaimers

15. Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, for our gross negligence or willful misconduct, or for death or personal injury caused by our negligence. Some places do not allow certain disclaimers or limits, so some of sections 14 and 15 may not apply to you. Where that is the case, our liability is limited only as far as the law allows.

16. Indemnity

If someone brings a claim against us because you broke these terms or the law while using IOn Reclaim, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows. This does not apply to claims caused by our own fault.

17. Ending these terms, and deleting your data

• You can stop using IOn Reclaim at any time. You can delete your account and cloud backup in the app (in Settings, in version 1.7.0 and later) or by email, and you can erase the data on your phone by clearing the app's storage or uninstalling it. The steps and what is deleted are on the account deletion page. If you have a Pro subscription from an earlier version, cancel it in Google Play separately.
• We may suspend or end your access to the app or cloud backup if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering the app. Where we reasonably can, we will tell you first and give you a chance to fix the problem or export your data.
• Sections 4, 6, 11 and 14 to 21 continue to apply after these terms end.

18. Changes to these terms

We may update these terms. We will change the date at the top when we do. If a change is material, for example to liability, how disputes are handled, or anything you would pay for, we will tell you in the app or on the Google Play listing before it takes effect. Changes do not apply to past events. If you do not agree to a change, stop using the app before it takes effect. Continuing to use the app after that means you accept the updated terms.

19. Governing law and disputes

• Talk to us first. If you have a problem, email us. We will try to resolve it informally within 30 days before either of us goes to court.
• Governing law. These terms are governed by the laws of the State of South Dakota, USA, without regard to its conflict-of-laws rules.
• Courts. Disputes will be heard in the state or federal courts located in South Dakota, and you and we consent to their jurisdiction. If you are a consumer and the law where you live gives you the right to bring a claim in your local courts, you keep that right.
• Individual claims. To the extent the law allows, claims must be brought individually, not as part of a class or representative action.
• Your consumer rights. Nothing in these terms affects rights you have as a consumer that cannot be waived or limited by contract under the law where you live.

20. General

These terms, together with the privacy policy, are the whole agreement between you and us about IOn Reclaim. If a court finds part of them unenforceable, that part is limited as little as necessary and the rest stays in effect. If we do not enforce a term straight away, we can still enforce it later. You may not transfer these terms to anyone else. We may transfer them to a company that takes over IOn Reclaim, and your rights under them will continue. We are not responsible for delays or failures caused by events outside our reasonable control.
